This Digital Products Policy governs the sale and delivery of digital photography products by Sim McKie’s Photography. By purchasing or booking services that result in digital image delivery, you agree to the terms outlined below.
1. Nature of Digital Products
Our core services include photography sessions that result in the delivery of digitally edited photographs. These are considered intangible products and are delivered electronically via a secure online gallery or download link.
2. Delivery Timeframe
Digital images are typically delivered within 7 to 14 working days after the session date. In some cases (e.g., high-demand periods or large events), delivery may take longer. Clients will be notified of any expected delays in advance.
3. Non-Refundable Policy
Due to the non-tangible and consumable nature of digital content:

All digital photography products are non-refundable once delivered.

Clients are not entitled to refunds once the gallery or final edits have been sent, downloaded, or viewed.
4. Revisions and Customer Satisfaction
If you are unsatisfied with your final images, please contact us within 7 calendar days of delivery. Pholux Collab Ltd will evaluate requests for minor edits or adjustments at our discretion. Major re-edits or alternate sessions may incur additional charges.
5. Usage License
All digital images remain the intellectual property and copyright of Pholux Collab Ltd (trading as Sim McKie’s Photography), a trading name of Pholux Collab Ltd, unless otherwise agreed in writing.
Clients are granted a non-exclusive licence to use the delivered images for personal use, including social media, personal portfolios, and casting profiles.
Commercial use, resale, redistribution, or modification for advertising purposes requires prior written permission.
Clients are granted a personal use license for all delivered digital images. This allows you to:

Print, share, and store the images for personal use.

Use the images on personal social media accounts (with credit where applicable).
You may not:

Use the images for commercial purposes without prior written consent.

Alter, resell, or distribute the images for profit or use by third parties.
6. Copyright
All digital images remain the intellectual property of Pholux Collab Ltd. The Company retains copyright and the right to use select images. We retain copyright and the right to use select images in our portfolio, marketing, or social media, unless the client explicitly opts out in writing.
