These Terms & Conditions govern the use of services provided by Sim McKie’s Photography, a trading name of Pholux Collab Ltd.
Pholux Collab Ltd is the legal entity responsible for operating this business, managing bookings, and providing photography services through the Sim McKie’s Photography brand.

By booking a service, using this website, or engaging with Sim McKie’s Photography, you agree to be bound by these Terms & Conditions.

These Terms & Conditions ("Terms") govern your use of this website and any services offered by Pholux Collab Ltd (trading as Sim McKie’s Photography). By accessing or using this website, booking a service, or engaging with our content, you agree to be bound by these Terms.
1. Use of Website

You must be at least 18 years old to make a booking or purchase services from this website.

You agree to use this website only for lawful purposes and not to use it in any way that may infringe the rights of others.
2. Services Offered

Sim McKie’s Photography provides photography services including (but not limited to): headshots, family portraits, events, and weddings.

Services are subject to availability and confirmed only upon receipt of a payment.

Services are offered in Day and Night Packages.
If a Day package extends more than one hour into Night hours (20:00–08:00), the additional time will be billed at the Night package rate for the corresponding service. Clients are responsible for selecting the appropriate package based on their shoot time. Sim McKie’s Photography reserves the right to adjust the final invoice to reflect Night package pricing if a Day session runs into Night hours. -
We reserve the right to modify or discontinue services at any time without prior notice.
3. Travel & Accommodation Policy
Sim McKie’s Photography provides photography services both locally and internationally.
For any booking that requires travel beyond a 10-mile radius of Manchester, additional travel and/or accommodation charges will apply.

Mileage: Travel is charged at £25 (round trip) for locations beyond 10 miles from Manchester.

Accommodation & Meals: For locations requiring overnight stays, reasonable accommodation and meal expenses will be invoiced at cost.

Destination / International Bookings: Clients are responsible for covering all travel-related costs, including flights, transfers, accommodation, and meals where applicable.

Advance Agreement: All travel arrangements and expenses will be discussed, confirmed, and agreed upon in writing prior to the booking date.

Travel Time: Extended travel times may count toward total booking hours if they exceed reasonable limits or impact the shoot schedule.
Sim McKie’s Photography reserves the right to decline bookings that require extensive travel where logistics, scheduling, or safety cannot be reasonably accommodated.
4. Booking and Payment

Bookings require a non-refundable payment at the time of confirmation.

Full payment is due prior to the session, unless otherwise agreed in writing.

Accepted payment methods include bank transfer, PayPal, Google or Apple Pay.
5. Cancellations and Refunds

Please refer to our separate [Refund Policy] for detailed information on cancellations, rescheduling, and refunds.
6. Image Use & Copyright

All images captured remain the copyright of Sim McKie’s Photography.

Clients are granted personal use rights, including printing and sharing images for non-commercial use.

Sim McKie’s Photography reserves the right to use selected images for portfolio, social media, and promotional materials, unless the client has signed an agreement opting out.
7. Intellectual Property

All content on this website, including text, images, logos, and branding, is owned by Pholux Collab Ltd and protected by copyright laws.

You may not reproduce, distribute, or use any content without express permission.
8. Liability

While we take great care in providing a professional and timely service, Pholux Collab Ltd is not liable for any indirect or consequential loss, damage, or expense incurred by you.

Our liability is limited to the total amount paid for the services in question.
9. Terms for Photographers (Self-Employed Contractors)
Photographers who apply to join our platform and accept bookings through Pholux Collab Ltd agree to the following additional terms:
9.1 Self-Employment Status
Photographers are self-employed independent contractors, not employees of Pholux Collab Ltd. You are responsible for your own taxes, insurance, and legal compliance. Photographers have the right to provide a suitably qualified substitute to perform the services, provided the substitute meets the Company’s quality standards and holds the required insurance.
9.1.1 Insurance Requirements
To ensure safety, professionalism, and compliance, all self-employed photographers working with Pholux Collab Ltd must maintain valid insurance coverage. he Photographer agrees to indemnify Pholux Collab Ltd against any claims, damages, or legal costs arising from the Photographer's performance or conduct during an assignment.
By joining our platform or accepting a booking, you agree to the following:

Proof of Insurance: You must provide a valid Certificate of Insurance (COI) showing active Public Liability Insurance (PLI) and Professional Indemnity Insurance (PII) before being assigned any jobs.

Minimum Cover: PLI must provide a minimum of £2 million coverage (or higher if required by a venue).

Equipment Responsibility: You are responsible for insuring your own photography gear. Sim McKie’s Photography does not cover damage, loss, or theft of personal or rented equipment.

Optional Insurance: It is strongly recommended that you hold Personal Accident or Income Protection Insurance in case of illness or injury.

Liability: Pholux Collab Ltd is not responsible for claims, damages, or losses arising from the actions or omissions of self-employed photographers.

Failure to Comply: Failure to provide valid insurance documentation or maintain active coverage may result in suspension or removal from the platform.
9.2 Payment & Revenue Split
Payments to Photographers will be processed within [e.g., 7-14] days following the successful delivery of edited images and the receipt of cleared funds from the Client.
For each completed and confirmed job:

Photographers receive 90% of the total fee.

Pholux Collab Ltd retains 10% for business operations, marketing, customer service, admin, and payment processing.

Optional Advertising Contributions (Boost Plans):
Photographers may choose to support marketing and promotion
through one of the following plans:
Plan Contribution Benefits
-
General Ads - £20 per month. Your profile is included in general promotional campaigns and social media ads.

Bronze Boost - £35 per month. General Ads benefits + featured placement on the website for your services.
-
Silver Boost - £55 per month. Bronze benefits + monthly spotlight in email campaigns and social media.
-
Gold Boost - £80 per month. Silver benefits + priority listing fo high-demand bookings, featured posts, and premium marketing exposure.

Contributions are optional and can be changed or canceled via the photographer’s account settings.

Payment for the selected boost plan will be collected alongside weekly or monthly payments, depending on the plan.
9.3 Booking Process
Photographers will have access to a secure dashboard where they can:

Set their availability (indicate days/times they are available to work)

View their confirmed bookings

Access basic job information once assigned
Photographers do not choose individual jobs. Jobs are assigned by Pholux Collab Ltd based on:

Experience

client request
By joining the platform, you agree to attend and complete any job assigned to you during the availability you have set. Failure to attend a confirmed job without sufficient notice may result in removal from the platform
9.3.1 No Guarantee of Work
Pholux Collab Ltd does not guarantee the provision of any specific number of jobs or bookings. Work is subject to client demand, suitability, and availability. Photographers may not receive regular or any assignments while listed on the platform.
9.4 Conduct & Standards
By joining the platform, you agree to:

Represent Pholux Collab Ltd professionally at all times.

Maintain punctuality, quality standards, and clear communication with clients.

Deliver edited photos by the agreed deadline.

Use your own equipment unless otherwise specified.
Failure to meet these expectations may result in removal from the platform.
9.5 Copyright & Usage Rights
Photographers retain full copyright of the images they capture unless otherwise contracted.
Pholux Collab Ltd is granted a non-exclusive, royalty-free licence to use submitted images for:

Client delivery

Marketing and promotional use (including social media, website features, and branded content)

Website and platform displays
Photographers will be credited where appropriate. If you do not wish for your images to be used in this way, please notify us in writing at the time of submission.
10. Portfolio & Promotional Use
Sim McKie’s Photography reserves the right to use photographs for portfolio display, marketing materials, social media, website galleries, competitions, and promotional purposes unless the client requests otherwise in writing prior to the session.
11. Changes to These Terms
Pholux Collab Ltd reserves the right to update or change these Terms at any time. Any changes will be posted on this page, and continued use of the website or services constitutes acceptance of those changes.
